《上市公司股權(quán)激勵(lì)管理辦法》第十三條規(guī)定:股權(quán)激勵(lì)計(jì)劃的有效期從首次授子權(quán)益日起不得超過10年,。山東股權(quán)激勵(lì)計(jì)劃實(shí)際約定的有效期是和下面因素有關(guān),如下:

(一)和企業(yè)階段性目標(biāo)(階段性項(xiàng)目)時(shí)間周期有關(guān)股權(quán)激勵(lì)計(jì)劃的有效期和完成“企業(yè)階段性目標(biāo)(階段性項(xiàng)目)”所需要的時(shí)間應(yīng)該一致,。如果股權(quán)激勵(lì)周期和戰(zhàn)略周期不匹配,,無論有效期過長(zhǎng)還是過短,都不利于實(shí)現(xiàn)企業(yè)戰(zhàn)略性目標(biāo),,就會(huì)出現(xiàn)“股權(quán)激勵(lì)計(jì)劃結(jié)束了,,但戰(zhàn)略規(guī)劃還沒有到期”或者“戰(zhàn)略規(guī)劃到期了,但是股權(quán)激勵(lì)計(jì)劃還沒有結(jié)束”的情況,。
